The suspect breathes into the breathalyzer, which then measures the amount of alcohol on the person’s breath based on how much alcohol has passed from the bloodstream into the lungs. In all states, the legal limit is 0.08% BAC (blood alcohol content). If the breathalyzer result is above the legal limit, the suspect is then taken into custody on suspicion of driving while intoxicated (DWI). In many states, however, the suspect can be arrested for driving under the influence (DUI) at BAC levels as low as 0.05%.
Alcohol breathalyzer testing can be very effective for officers in the field because it is quick, efficient and non-invasive to the suspect. Typically, two breathalyzer tests are given at least two minutes apart to ensure the test results are accurate. The test is given while the officers observe the suspect for at least fifteen minutes to check their behavior and to make sure the test is not tainted by anything the suspect eats, drinks or vomits.
